01Acceptance Of Terms

These Terms of Service govern your access to and use of the Assetopia Inc website and the Assetopia.AI application, together referred to as the Services. Assetopia Inc provides the Services. Please read these terms before using them. If you do not agree to these terms, do not use the Services.

A separately agreed written contract may govern a consulting engagement or other service. If that contract conflicts with these terms, the separate contract takes precedence for that engagement.

02Eligibility And Accounts

All Assetopia services and applications are intended only for adults aged 18 or over. You must be at least 18 to use them. If you use the Services on behalf of an organization, you must have authority to do so.

Provide accurate account information, keep your sign-in credentials confidential, and notify us promptly if you suspect unauthorized access. Do not share credentials or use another person's account without authorization.

03Website And Application Services

The website provides company, consulting, and product information. Assetopia.AI provides tools for organizing uploaded portfolio and transaction information, reviewing financial data, and generating analysis and AI-assisted insights, depending on the features available to you.

Using the website or application does not by itself establish an advisory, fiduciary, brokerage, or professional advisory relationship with Assetopia Inc.

04No Financial Advice

Website content and application outputs, including portfolio analysis, calculations, and AI-generated responses, are for informational purposes only. They are not individualized financial, investment, tax, accounting, legal, brokerage, or trading advice. Outputs based on your portfolio or questions do not change this informational purpose.

You are responsible for your own financial decisions and should consult qualified professionals before making investment or financial decisions.

05Portfolio Uploads And Your Content

You retain any ownership rights you have in the files, portfolio records, transaction data, questions, and other content you provide. You must have the rights and authority needed to submit that content, including permission where it contains information about another person or organization.

You authorize Assetopia and the service providers supporting the relevant features to host, process, format, and analyze your content as necessary to provide those features, maintain security, and respond to support requests. This permission does not transfer ownership of your content to Assetopia. Handling of personal information is described in our Privacy Policy.

Review imported holdings, transactions, identifiers, currencies, and calculated values for accuracy. Importing and matching can produce errors or omissions. Keep independent copies of your original records; application outputs are not a substitute for official broker, custodian, accounting, or tax records. Do not include passwords, access tokens, or unrelated personal information in uploads or questions.

06AI Outputs And Financial Data

AI-generated responses may be inaccurate, incomplete, outdated, or misleading, even when expressed confidently. Verify material statements, calculations, and sources independently before relying on them. No output guarantees an investment outcome or future performance.

Market prices, exchange rates, valuations, and other third-party data may be delayed, unavailable, or subject to errors and licensing restrictions. Do not assume displayed data is real-time or suitable for executing a transaction. Historical results and illustrative scenarios do not predict future results.

07Product Availability

Features may depend on your account, service plan, region, and third-party availability. Roadmap items and illustrative examples are not commitments to deliver future functionality. This does not limit obligations relating to features or services we have agreed to provide, or your statutory rights.

Maintenance, technical problems, or third-party interruptions may affect access. Where paid services are offered, applicable prices, billing terms, renewal arrangements, and cancellation information must be provided before purchase. These terms do not establish a particular subscription price, automatic renewal arrangement, or no-refund policy.

08Acceptable Use

You may not misuse the Services, interfere with their operation, attempt unauthorized access to accounts or data, introduce malicious code, bypass access controls or usage limits, or use the Services in violation of law or another person's rights.

Do not upload content you are not authorized to provide, use the Services for fraud or market manipulation, or extract and redistribute third-party financial data without the necessary rights. Any restrictions remain subject to uses expressly permitted by applicable law.

09Intellectual Property

The website, application software, brand elements, design, and related materials are owned by Assetopia Inc or its licensors. Subject to these terms and applicable service entitlements, you may access and use the Services for their intended purposes. You may not copy, modify, distribute, or create derivative works from our software or materials except as permitted by law or with written permission. This does not claim ownership of your uploaded content.

10Third-Party Services

The Services may rely on hosting, database, authentication, market-data, and external AI providers. Relevant content may be processed by these providers as described in our Privacy Policy.

Independent third-party websites or services you choose to use may have their own terms and privacy notices. We do not control those independent services. This does not exclude our responsibility for the Services we provide or obligations that cannot be excluded by law.

11Privacy And Account Closure

Our Privacy Policy describes the handling of account information, uploaded portfolios, transactions, AI inputs, and related records, including privacy rights for EEA and UK users. These terms do not replace that notice or constitute consent to processing that requires separate consent.

You may stop using the Services and contact hello@assetopiainc.com to request account closure or deletion of personal information. Closure and deletion are distinct from any applicable paid-plan cancellation process. Retention and deletion, including legal retention requirements and backup copies, are addressed in the Privacy Policy.

12Suspension Of Access

We may restrict or suspend access where reasonably necessary to address a material breach of these terms, protect users or the Services from security threats, or comply with law. Any action should be proportionate to the circumstances. Where reasonably possible and lawful, we will provide notice and an opportunity to resolve the issue; urgent security or legal circumstances may require immediate action.

Contact hello@assetopiainc.com if you believe access was restricted in error. Suspension does not remove statutory rights or any refund or other remedy required by law.

13Disclaimer Of Warranties

Subject to our contractual obligations and your statutory rights, we do not guarantee that the Services will be uninterrupted or error-free, or that every data item or AI output will be accurate. To the extent permitted by applicable law, the Services are otherwise provided on an as-is and as-available basis. This does not exclude mandatory standards of quality, fitness, conformity with description, or reasonable care and skill.

14Limitation Of Liability

For business users, to the extent permitted by law, Assetopia Inc is not liable for indirect or consequential losses, or loss of profits, revenue, goodwill, or business opportunities arising from use of the Services.

For consumers, these terms do not exclude liability for losses for which we are responsible under applicable consumer law. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

15Consumer Rights

Nothing in these terms limits mandatory consumer or data protection rights. If you are a consumer in the EEA or United Kingdom, applicable rights relating to digital content and services, cancellation, remedies, and access to competent courts remain unaffected.

16Changes To These Terms

We may update these terms to reflect changes to the Services, legal requirements, or security needs. We will post the revised terms with an updated date and provide advance notice of material changes where required by law or an applicable contract. Changes will not retrospectively remove accrued rights. Where renewed agreement is required, we will seek it.
